Welcome to Apotheca. These Terms of Service ("Terms") govern your use of apotheca.market (the "Site") and the products, services, and features we provide. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Apotheca is a practitioner-grade supplement marketplace operated by [Legal Entity Name, LLC] ("Apotheca," "we," "us," "our"). Apotheca is powered by Gabriel Health Intelligence for product scoring, safety checks, and clinical review workflows. We partner with licensed and compounding pharmacies and licensed healthcare providers to offer prescription products through an integrated telehealth model.

2. Eligibility

To purchase products from Apotheca, you must be:

• At least 18 years of age (or the age of majority in your jurisdiction)
• Legally able to enter a binding contract
• A resident of a U.S. state where we are licensed to ship the product you are purchasing
• Providing accurate, complete information at checkout and during any health intake

For prescription (Rx) products, additional eligibility requirements apply — see Section 6.

3. Account Registration

You may create an Apotheca account to save your Health Profile, track orders, participate in Wellness Circles, and expedite future purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@apotheca.market if you suspect unauthorized use.

4. Product Categories

Apotheca offers four product categories, each governed by different rules:

4.1 Supplements, Vitamins, and Minerals

Over-the-counter dietary supplements available for direct purchase. These products are not drugs. Statements regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease. Always consult your healthcare provider before starting any supplement regimen.

4.2 Peptide Bioregulators, Oral Peptides, and Topical Peptides

Non-prescription peptide formulations sold as research compounds or topical cosmetics depending on the product. These are not FDA-approved for any human medical indication and are intended for personal use at your discretion and under the guidance of a qualified healthcare professional where applicable.

4.3 Prescription (Rx) Products

Injectable peptides, compounded medications, and other prescription products. These require:

• Completion of our integrated health intake
• Review and approval by a licensed healthcare provider in your state
• Compounding by a licensed pharmacy partner (when prescription products are offered)
• Valid medical purpose as determined by your reviewing clinician

4.4 Diagnostic Lab Tests

Lab test kits and provider-ordered diagnostics. Results are delivered through the ordering lab and interpreted by a qualified provider.

5. Medical Disclaimer

Apotheca is not a substitute for professional medical advice, diagnosis, or treatment. Information on the Site — including Gabriel Scores, product descriptions, research summaries, reviews, protocols, and educational content — is for informational purposes only.

• Always seek the advice of your physician or other qualified healthcare provider before starting any supplement, peptide, prescription medication, or health protocol.
• Never disregard professional medical advice or delay seeking it because of information you've read on Apotheca.
• In a medical emergency, call 911 or go to the nearest emergency room.
• Gabriel AI is an intelligence layer that aggregates and analyzes publicly available research and practitioner data. Gabriel does not provide medical advice, diagnosis, or treatment recommendations.

6. Telehealth and Prescription Products

6.1 Our telehealth model

When you purchase a prescription product, you are engaging our integrated telehealth service:

1. Checkout — Add the Rx product to your cart and complete checkout. Your payment is authorized but not charged until clinician approval.

2. Health Intake — Complete a 2-minute async health questionnaire covering your medical history, current medications, allergies, and goals. Saves to your Apotheca profile for future orders.

3. Clinician Review — A licensed healthcare provider in your state reviews your intake using Gabriel clinical intelligence. Most reviews completed same-day.

4. Compounding & Shipping — If approved, a licensed compounding pharmacy partner compounds your formulation and ships within 48 hours with cold-chain packaging where required.

6.2 If your protocol is not approved

If the reviewing clinician determines a product is not appropriate for you, your payment authorization is released and you are not charged. Alternatively, if charged, you receive a full refund within 3–5 business days.

6.3 State licensure

We only dispense prescription products in states where we maintain valid pharmacy and provider licensure. If you reside in a state where we cannot legally ship a given product, your order for that product will be canceled and refunded.

6.4 Informed consent

By purchasing a prescription product, you acknowledge that you have read and agree to our Telehealth Consent page and understand the limitations of asynchronous telehealth care.

6.5 Controlled substances

Apotheca does not dispense Schedule I–V controlled substances. Compounded non-scheduled peptides and other non-controlled prescription products are dispensed per applicable state and federal laws governing compounding pharmacy practice.

7. Pricing, Payment, and Billing

• All prices are in U.S. dollars.
• We reserve the right to correct pricing errors at any time, including after an order is placed, in which case we will notify you and offer a refund or option to confirm the corrected price.
• Applicable state and local sales taxes are calculated at checkout.
• For Wellness Circle orders, circle pricing is locked only when the full group threshold is met within the 48-hour window.
• Payment is processed via our payment provider(s). Your card is authorized at checkout. For Rx products, the charge is finalized only upon clinician approval and compounding.

See our Shipping Policy for full details. In summary: U.S. domestic shipping only; free shipping on orders over $99; Rx products ship in cold-chain packaging within 48 hours of approval; signature may be required for injectables.

9. Returns and Refunds

See our Refund Policy for full details. In summary: 30-day money-back guarantee on unopened supplements; free replacement for damaged Rx products within 48 hours; full refund if your Rx protocol is not approved.

10. Intellectual Property

All content on the Site — including the Apotheca name, Gabriel name, Gabriel Score methodology, product descriptions, editorial content, review aggregation, site design, and software — is the property of Apotheca, Gabriel Health Intelligence, or their respective licensors. You may not reproduce, distribute, or create derivative works without written permission.

Product names, brand names, and trademarks of third-party manufacturers are the property of their respective owners and are used for identification only.

11. User Content

If you submit reviews, Q&A responses, Wellness Circle messages, or other content to Apotheca, you grant us a non-exclusive, royalty-free, perpetual license to use, display, and distribute that content in connection with the Site. You represent that you own or have rights to submit this content, and it does not violate any third party's rights.

We reserve the right to remove any content that is fraudulent, abusive, off-topic, or otherwise violates these Terms.

12. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose
• Impersonate another person or misrepresent your identity
• Reverse-engineer, scrape, or harvest data from the Site
• Introduce malware or attempt to gain unauthorized access
• Purchase products for resale without our express written permission
• Misrepresent your health history during intake to obtain a prescription

13. Wellness Circles

Wellness Circles are group-pricing sessions. Participation is voluntary. Circle pricing is locked only when the member threshold is reached within the 48-hour window. If a circle does not reach its threshold, individual members' orders are processed at standard pricing or may be cancelled at your election. Circle discount codes are not transferable and are tied to the specific circle session.

14. Disclaimers of Warranties

The Site and all products are provided "as is" and "as available" without warranty of any kind, express or implied, except as explicitly required by law.

We do not warrant that:

• The Site will be uninterrupted or error-free
• Any particular supplement or peptide will produce specific results
• Gabriel Scores or research summaries are complete or error-free
• Third-party product information provided by manufacturers is accurate in every detail

15. Limitation of Liability

To the fullest extent permitted by law, Apotheca, Gabriel Health Intelligence, our officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product purchased through it.

Our total liability for any claim arising from a product purchased through Apotheca shall not exceed the amount you paid for that product.

Nothing in these Terms limits liability for: (a) fraud or willful misconduct; (b) death or personal injury caused by negligence where prohibited by applicable law; or (c) any other liability that cannot be excluded by law.

16. Indemnification

You agree to indemnify and hold Apotheca, Gabriel Health Intelligence, and our affiliates harmless from any claim arising out of your use of the Site, your violation of these Terms, your violation of applicable law, or your misrepresentation during health intake.

17. Dispute Resolution

Any dispute arising from these Terms or your use of the Site will be resolved through binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, conducted in [County, State]. You waive any right to participate in class action lawsuits or class-wide arbitration.

Exceptions: Small-claims court disputes and claims for injunctive relief regarding intellectual property remain in the appropriate courts.

18. Governing Law
