1. About these terms

These Terms of Service ("Terms") apply when you visit apotheca.market, create an account, or buy anything from Apotheca ("Apotheca," "we," "us" or "our"), including purchases made through an AI assistant or shopping agent. By using the site or placing an order, you agree to these Terms and to our Privacy Policy, Return and Refund Policy and Shipping Policy. If you don't agree, please don't use the site.

2. Who can buy

You must be at least 18 years old and able to enter into a binding agreement. We ship only within the United States, as described in our Shipping Policy.

3. Health information

Product information on this site is general education. It is not medical advice and does not replace advice from your own doctor or another qualified health professional. Talk with your healthcare provider before starting a supplement, especially if you are pregnant or nursing, take medication, or have a medical condition.

Statements about dietary supplements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

We work to keep product details accurate, but manufacturers can change formulas, labels and packaging. Always read the label on the product you receive.

4. Prescription products

Some products require a prescription. A licensed clinician reviews the health information you provide and decides whether a prescription is appropriate, so approval is never guaranteed. Prescription products are filled by licensed pharmacy partners and ship only to states where our pharmacy and provider partners are licensed. You are charged for a prescription product only if a clinician approves it, as described in our Return and Refund Policy. You agree to give complete and accurate health information.

5. Orders, prices and availability

Prices are in U.S. dollars. Taxes and shipping are shown at checkout. We may limit quantities, and we may refuse or cancel an order, for example when a product is unavailable, a price or description was listed in error, or we suspect fraud or unauthorized resale. If we cancel an order after you have paid, we refund you in full.

6. Payment

You can pay with the methods shown at checkout, which may include credit and debit cards, Shop Pay, Apple Pay and Google Pay. You authorize us and our payment processors to charge your payment method for your order, including taxes and shipping.

7. Orders placed through AI assistants and shopping agents

You can find and buy Apotheca products through AI assistants and shopping agents, such as ChatGPT, Microsoft Copilot, Meta AI, the Shop app or Gabriel. An agent you use acts on your instructions. You are responsible for the orders you authorize it to place, and these Terms apply to those orders just as they apply to orders on our site. Please review your order confirmation and contact us right away at support@apotheca.market about any order you did not intend to place. The agent's own terms and privacy practices also apply to your use of it.

8. Shipping, returns and refunds

Shipping times, costs and restrictions are set out in our Shipping Policy. Returns and refunds follow our Return and Refund Policy.

9. Your account

Keep your login details private and tell us promptly if you think someone else is using your account. You are responsible for activity in your account.

10. Personal use

Products are sold for your personal use and not for resale, unless we agree otherwise in writing.

11. Acceptable use

Do not use the site to break the law, to interfere with the site or its security, to access it with automated tools other than the shopping-agent interfaces we make available, or to post content that is false, infringing or harmful.

12. Reviews and content you share

If you post a review or other content, you confirm that it reflects your honest experience, and you give us a non-exclusive, royalty-free license to display and share it in connection with Apotheca. We may remove content that breaks these Terms.

13. Our content

The site's text, images, scores and design belong to Apotheca or its licensors. Brand names, logos and product images belong to their owners.

14. Third-party services

The site links to and works with services run by others, such as payment processors, carriers, pharmacies, clinicians and shopping agents. Their own terms apply to their services, and we are not responsible for them.

15. Disclaimers

Except as stated in these Terms and our policies, and to the fullest extent the law allows, the site and products are provided "as is," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. This does not limit any manufacturer's warranty or any right you have by law that cannot be waived.

16. Limitation of liability

To the fullest extent the law allows, Apotheca and its owners, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim relating to the site or a product is limited to the amount you paid for that product. Some places do not allow these limits, so they may not apply to you.

17. Indemnity

You agree to cover losses and reasonable costs we incur because you broke these Terms or the law.

18. Changes to these Terms

We may update these Terms. The version posted when you place an order applies to that order, and the date at the top shows the latest update.
